{"id":67090,"date":"2026-06-19T10:08:24","date_gmt":"2026-06-19T08:08:24","guid":{"rendered":"https:\/\/www.usd.de\/?p=67090"},"modified":"2026-06-19T10:25:35","modified_gmt":"2026-06-19T08:25:35","slug":"kamarisk-consultation-phase","status":"publish","type":"post","link":"https:\/\/www.usd.de\/en\/kamarisk-consultation-phase\/","title":{"rendered":"KAMaRisk in the Consultation Phase"},"content":{"rendered":"\n<p>After Bafin (Federal Financial Supervisory Authority) released the <a href=\"https:\/\/www.bafin.de\/SharedDocs\/Veroeffentlichungen\/DE\/Meldung\/2026\/meldung_2026_04_01_konsultation_02_2026_marisk-novelle.html\" data-type=\"link\" data-id=\"https:\/\/www.bafin.de\/SharedDocs\/Veroeffentlichungen\/DE\/Meldung\/2026\/meldung_2026_04_01_konsultation_02_2026_marisk-novelle.html\" target=\"_blank\" rel=\"noopener\">draft of the 9th amendment to MaRisk for consultation<\/a> in early April, the consultation version of the <strong>Minimum Requirements for Risk Management at Capital Management Companies (KAMaRisk)<\/strong> has been available since <a href=\"https:\/\/www.bafin.de\/SharedDocs\/Veroeffentlichungen\/DE\/Meldung\/2026\/meldung_2026_06_12_konsultation_kama_risk.html\" data-type=\"link\" data-id=\"https:\/\/www.bafin.de\/SharedDocs\/Veroeffentlichungen\/DE\/Meldung\/2026\/meldung_2026_06_12_konsultation_kama_risk.html\" target=\"_blank\" rel=\"noopener\">12 June 2026<\/a>. With this, the supervisory authority is continuing to advance the revision of its circulars in the financial sector.<\/p>\n\n\n\n<p>One of the reasons for the revision is the Fund Risk Limitation Act (FRiG). It transposes the revised EU Directive on the Regulation of Alternative Investment Funds (AIFMD II) into German law and establishes harmonized requirements for credit funds in the EU. Accordingly, in KAMaRisk, Bafin is revising, in particular, the requirements for lending by alternative investment funds (AIFs) and simplifying the requirements in several areas.<\/p>\n\n\n\n<div style=\"height:23px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">What Else Stands Out?<\/h2>\n\n\n\n<p>In addition, Bafin is revising the KAMaRisk in several sections to eliminate overlaps with the Digital Operational Resilience Act (<a href=\"https:\/\/www.usd.de\/en\/security-consulting\/dora\/\">DORA<\/a>). For example, the section on electronic data processing has been removed. Duplication of regulation is also to be avoided in the chapter on outsourcing: ICT services already governed by DORA are not to be subject to the corresponding KAMaRisk requirements as well.<\/p>\n\n\n\n<p>Bafin is explicitly focusing on ESG (Environmental, Social, Governance) risks. The requirements for internal audit are also being tightened: Internal audit staff may not audit activities for which they themselves were responsible in the past twelve months. In the future, the internal audit function will also report to management and the supervisory board.<\/p>\n\n\n\n<div style=\"height:23px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Implications from a Regulatory Perspective<\/h2>\n\n\n\n<p>Anyone who has been following the current MaRisk consultation phase will recognize the general direction. In that consultation phase as well, Bafin had announced its intention to make the requirements more principles-based, reduce complexity, and clarify their application. KAMaRisk continues this approach for capital management companies, while setting its own technical priorities.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-vertically-aligned-center is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\"Overall, the proposed changes provide a pragmatic and welcome relief. By removing requirements that are already covered by DORA, the KAMaRisk consultation reduces regulatory overlap.
